1. Acceptance of Terms

By accessing and using SmartBlower's AI-powered automated ventilation services, you agree to be legally bound by these Terms of Use. If you do not agree with any part of these terms, you must not use our services.

These terms constitute a legal agreement between you (the "User") and SmartBlower ("we", "our").

2. Description of Service

SmartBlower provides AI-powered automated ventilation systems, including IoT sensors, control algorithms, and monitoring software for optimizing airflow in industrial environments, such as wind tunnels.

The service involves the integration of hardware and software for automated control, based on real-time data. We do not guarantee specific energy efficiency or performance results, as these depend on external factors.

3. Rights and Obligations

3.1. User Obligations

The User agrees to:

• Use the service only for lawful purposes and in accordance with its designed purpose.
• Provide accurate and up-to-date information for system configuration.
• Maintain the security of their access credentials and notify any unauthorized use.
• Not attempt to decompile, modify, or interfere with the system's hardware or software.

3.2. SmartBlower Rights

We reserve the right to:

• Suspend or terminate access to the service for breach of these terms.
• Update, modify, or discontinue service features with prior notice.
• Access system data anonymously and in aggregate to improve our algorithms.

4. Limitation of Liability

The service is provided "as is" and "as available". To the maximum extent permitted by law, SmartBlower shall not be liable for:

• Indirect, incidental, or consequential damages (loss of profits, business interruption).
• Damages resulting from misuse, incorrect installation, or unauthorized modifications by the User.
• Force majeure events or circumstances beyond our reasonable control.

Our total liability in any claim related to these terms shall not exceed the amount paid by the User for the service in the last 12 months.

5. Intellectual Property

All software, algorithms, interfaces, documentation, and know-how related to the SmartBlower ventilation system are the exclusive property of SmartBlower or its licensors. The User is granted a limited, non-exclusive, non-transferable license to use the software solely in connection with the purchased hardware.

The User does not acquire any ownership rights over the underlying technology.

6. Termination

Either party may terminate this agreement with 30 days' written notice. SmartBlower may terminate access immediately if the User materially breaches these terms.

Upon termination, the User must cease using the software and allow remote uninstallation. The sections on Limitation of Liability, Intellectual Property, and Governing Law shall survive.

7. Modifications to Terms

We reserve the right to modify these Terms of Use at any time. Modifications will take effect after being published on this page or via email notification.

Continued use of the service after such changes constitutes acceptance of the new terms. It is recommended to review this section periodically.

These Terms of Use are governed by the laws of Spain. Any dispute shall be submitted to the courts of Barcelona.
